STARKE COUNTY COMMISSIONERS RESOLUTION 2021- 015

OPT-OUT OF INDIANA ATTORNEY GENERAL OPIOID

SETTLEMENT PURSUANT TO IND. CODE S 4-6-15-2

THE BOARD OF COMMISSIONERS OF STARKE COUNTY, INDIANA (the “COMMISSIONERS”), hereby finds:

WHEREAS, the Commissioners, on behalf of the citizens of Starke County, Indiana, have been actively engaged in pursuing damages caused by the manufacture, sale, and distribution of opioids through outside counsel in multidistrict litigation since at least October 2018; and,

WHEREAS, the Commissioners, after due consideration, have determined that it is in the best interests of the citizens of Starke County to continue on their current litigation path and therefore to opt out of opioids settlements under Ind. Code S 4-6-15-2.

WHEREFORE the Board of Commissioners of Starke County, Indiana hereby RESOLVES to exercise their authority to elect to opt out of the opioids settlement under Ind. Code S 4-6-15-2, and hereby does opt out and furthermore asserts its intent to remain as a named party in the multidistrict opioid litigation. In addition, the Commissioners authorize and order the Auditor of Starke to submit (in consultation and coordination with the County Attorney and with Cohen Malad) a certified copy of this Resolution to the Office of the Indiana Attorney General on or before June 30, 2021.

All of which is DULY ADOPTED at the regularly scheduled public meeting of the Board of Commissioners this 7th day June 2021, by the following vote of its members:

NOTICE OF OPIOID LITIGATION OPT-OUT PURSUANT TO IND. CODE S 4-6-15-2

THE COUNTY OF STARKE by its duly elected Board of Commissioners hereby submits NOTICE to the Indiana Attorney General that it elects to OPT-OUT of the opioids settlement pursuant to Ind. Code 4-6-15-2(b).

The County of Starke hereby submits the following information pursuant to Indiana Code 4-6-15-2(c).

(l) That name of the political subdivision election to opt-out is Starke County.
