STARKE COUNTY COUNCIL RESOLUTION 2019-13 AUDITOR’S TRANSFER FEE

WHEREAS on February 9, 2006, the Starke County Council (the “Council”) adopted a RESOLUTION REQUESTINGTHE STARKE COUNTY COMMISSIONERS TO CONSIDER ADOPTION OF AN AUDITOR’S TRANSFER FEE as Resolution *2006-04.

AND WHEREAS Pursuant to the Ind. Code S 36-2-9-18, the Commissioners then adopted Resolution #2006-05 establishing an auditor’s transfer fee not to exceed five ($5) dollars per deed or parcel, and that the fees so collected would be placed in a dedicated fund for use in maintaining the county’s plat books. The Auditor’s office has since collected the transfer fee on such transactions since establishment of the fee without any increase in the fee rate.

AND WHEREAS Pursuant to HEA 1427, l.c. S 36-2-9-18, the Indiana Legislature has amended l.c. S 36-2-9-18 to authorize a transfer fee not to exceed ten ($10) dollars per deed or parcel, with the amendment effective July l, 2019. Also, HEA 1427 amends l.c. S 36-2-9-18 to explicitly allow dedication of the funds collected pursuant to the transfer fee for maintaining plat books in traditional or electronic formats.

The Council RECOMMENDS AND REQUESTS that the Commissioners

adopt a resolution increasing the Auditor’s Transfer Fee as authorized by HEA 1427, with such fee not to exceed ten ($10) per deed or parcel, with the fee increase effective July l, 2019, and that the fees so collected be deposited in a dedicated fund for maintaining plat books in traditional or electronic formats.
